I don't really post here but this is an interesting topic of discussion. That argument doesn't hold water because shooting porn without making pornography is illegal, it's prostitution. You are paying people for sex which is illegal in CA. This makes it quite clear that porn isn't just sex as far as the law is concerned so this is a simple work-place regulation. You can put up shelves without a hard-hat but you can't employ someone to do it without one. Furthermore many states set the age of consent below 18, but documenting this is totally illegal. I don't mean to compare bareback to child pornography but it's a simple example.
