In November, voters will be able to decide to extend the ban on bareback porn production across the entire county. Neighboring Simi County is preparing to write a similar measure, out of fear that if the initiative passes in LA, both gay and straight porn production will move to their county. So as you can see, this could be the start of something which could quickly spread across the entire state of California, which is our primary porn producing state. Are there any activists out there willing to take a stand. It is undferstandably challenging to take a stand on this to appear to support the porn industry or what others may feel is proper. My recommendation for those willing to talk about this with their friends in southern California would be to identify this as a freedom of speech, first amendment infringement. The free speech claim might make more sense if it was the "distribution" of the material being banned. The issue as I see it here, though, is more about on-the-job safety. Would be interested to know if they are also requiring condoms for sex workers...
einathens Posted August 27, 2012 Report Posted August 27, 2012 lawrence o'donnel did a really funny piece on this months ago when the subject forst came up, about how republicans have to be in favor of bareback porn. are they gonna prosecute amateur clips posted online? and the first amendment issue, i believe, is that the documentation of legal acts cannot be made illegal. the challenges will be plentiful, and they will prevail.

That argument doesn't hold water because shooting porn without making pornography is illegal, it's prostitution. You are paying people for sex which is illegal in CA. This makes it quite clear that porn isn't just sex as far as the law is concerned so this is a simple work-place regulation. You can put up shelves without a hard-hat but you can't employ someone to do it without one. Furthermore many states set the age of consent below 18, but documenting this is totally illegal. I don't mean to compare bareback to child pornography but it's a simple example.
