While poz tops in Canada have to watch out or they might get arrested, poz bottoms in Canada now have a green light to not disclose their status. A judge in Canada has found that HIV negative tops are not at enough risk for the poz bottom to be charged with a crime if he doesn't disclose.

A Canadian judge has ruled for the first time that an HIV-negative person is not placed at 'a significant risk of serious bodily harm' if they are the insertive partner in unprotected anal intercourse with an HIV-positive man.

According to a statement from the Canadian HIV/AIDS Legal Network this "reinforces the basic point that not every risk of transmission will be considered 'significant', and illustrates the importance of ensuring that courts consider carefully the scientific evidence before them in determining when there is a 'significant risk' of harm, rather than simply criminalising non-disclosure in all circumstances."

That's a very interesting post. In the U.K. and Europe, medical health professionals have long abandoned advising people to avoid getting cum in their mouths. They believe that the risk of getting pozzed that way is practically non existent.

If we now accept that active fuckers are at very little risk of contracting HIV by fucking a poz bottom, can we assume that HIV positive Tops must have acquired it from bottoming or sharing needles?

I used to go to a doctor who specialized in HIV. He had been specializing in HIV since it had been called "gay cancer". He once said to me that he hadn't met a guy yet who said he got HIV from topping whom he believed. Personally, I believe a few guys have gotten it from topping, but VERY few.

I suppose it could be that ( as with the risk of transmission from women to men via vaginal sex ) if the Top already has a sexually acquired infection it makes his cock and urethra more vulnerable to infection with HIV.
