A 29 y.o. Canadian guy from Ottawa (Steven Paul Boone) who went under the handle 'chasingpoz' on some bareback sites was arrested and charged with aggravated assault on an 18 y.o...

An investigation began April 30 after an Ottawa man told police he contracted the disease from Boone sometime between late January and early February this year.

The 18-year-old victim told the Citizen by phone Friday night that he had unprotected sex with Boone about nine times after arranging to meet on a gay dating website.

He said that every time they had sex, he asked Boone if he was HIV-positive, and that every time, Boone said no.

A little later on, a mutual friend of the 18-year-old -- who was 17 at the time -- and Boone found out the two were seeing each other, and advised him to get tested for HIV. Then, the victim said, Boone's roommate told him Boone was HIV-positive.

He is also wanted by Waterloo Regional Police on a warrant issued this week for the same offence and a similar set of circumstances

What an awful situation. With some simple honesty and decency this situation could have been avoided. In Aust we have to disclose our status as well. Something I don't have an issue with and I do every time. I agree with you rawTOP your advice is very sound. If you want raw cock just remember there are so many lying fucks out there treat them all as POZ untill proven NEG. We all have to accept some personal responsability for our own actions.

I find it very hard to believe that he inquired about the other guys status every single time they had sex. Regardless, asking someone about their status is not an effective way to protect yourself. He knew what he was getting into when he was repeatedly engaging in unprotected sex.

Good news in this case! The judge has said that spreading HIV is not attempted murder since it's unlikely anyone will die.

The ruling speaks to the medical advances made in fighting HIV/AIDS in the 30 years since the virus first started terrifying the gay community, but also suggests police and prosecutors have not moved with the times, AIDS specialists and activists said.

“In a country like Canada, where antiretroviral drugs of the highest quality are available to everyone free of charge, the likelihood anyone is going to die over the next 25 years from HIV is extremely remote,” said Mark Wainberg, director of the McGill AIDS Centre based at the Jewish General Hospital in Montreal.

“So the very notion that anyone could be charged with attempted murder today seems strange.”

The ruling highlights the lag time in the justice system.

Back 15 or 20 years, when HIV was usually a death sentence, no such criminal charges were laid. By the time prosecutors caught up to the impact of the social problem, science had passed them by, experts said.

More than 80 people, mostly men, have been charged in Canada with criminal offences for exposing sexual partners to HIV.

However, the case is going forward as a sexual assault case. Still, one would hope this would reduce prosecutor's zeal to go forward with these types of cases in the future.

having bareback sex is obviously high risk, frankly i don't think disclosing should even really be necessarily, because it's a 2-way street, the neg guy should be asking the questions if he really wants to stay neg, same time, lying about it is proper dodgy as well. Best bet for a poz guy if asked is to make sure that he confirms his status via an electronic method, be it a text, e-mail, IM, whatever, but if it's electronic, then there will be evidence for defence if some fuck-wit decides to try to act the innocent victim, if it's just verbal, then there's no evidence you actually confirmed your status before having sex

I'm glad to see the attempted murder charges have been dropped, but with 21 counts against him, he still faces many more years behind bars. It really makes me sick to see people charged like this. It's 2011. Everyone knows that unprotected sex has risks, ESPECIALLY this young 18 year old "victim". Safe sex and HIV prevention is drilled into kids in school these days, so they know the risks better than anyone.

Even the sexual assault charges are way too severe in my opinion. Would a straight man be charged with assault for impregnating a woman after telling her that he was sterile? I don't think so. I know, I know, the two situations are much different, but for me, HIV is much less worrisome that a screaming baby.

i suspect you are right cheshiregay, but it's entirely possible that he did lie, but either way, that's why i think it's important the poz guy confirms his status by an electronic method, cos those sorrta things don't disappear over night

Moral of the story: disclose, disclose, disclose! Put your status in your profiles. Tell guys up front and if you're hooking up online, tell them in an email message you can save to prove that they knew in advance. This is exactly why I put my HIV status in all of my online profiles, even the ones on sites where I don't really expect to hook up. I want to be able to provide proof that I've been extremely proactive about disclosure.

For those guys into converting neg guys, you better make damn sure that that guy you're breeding is really a chaser and that you can prove it. And oral disclosures are not enough (no proof). You probably want to do your hooking up online, from a profile that clearly states you have HIV and with a record that you took further steps to warn your partner (dated email messages where the guy explicitly acknowledges your status and states he still wants you to fuck him bareback and cum in his ass). And you probably want a third party knowing what's going on who can back your story up.

If you're into stealthing, then this right here should be a huge fucking wake-up call. There are some fantasies that should NEVER be allowed to cross into reality. This is one of them. The fucking huge moral problems aside, this case is proof that you can destroy your own life.

Prosecutors are vicious asshole rat-bastards. Many of them see their careers as preliminaries to political climbing, and putting away "sexual predators" who "spread AIDS" is a huge feather in their cap. They do not care about justice. They'll want your sex life in the media and they'll want to destroy YOU to further their careers.

Don't give them the excuse to do it.

You know, a lot of chasers and "don't care" types have ambivalent feelings about converting. And I think that's legitimate. There's a tension there between fear of infection, the hotness of the sex, all kinds of things. People change their minds, get regrets, so on and so forth. I understand that. HIV is a really big deal, even in 2011.

Which all really means that it is incumbent on the poz guy to be absolutely sure everyone involved knows exactly what he's getting into and agrees to it while he is demonstrably free of any coercion whatsoever.

Before acquiring HIV, I'd use protection religiously and remained negative for two years after having screwing with Lord-knows how many dudes at bath houses and sex parties. What makes me sick is I'd occasionally hook up with those guys who'd do everything in their power to either convince me to get fucked bareback or they'd attempt to take the rubber off during sex.

A fuck bud of mine that I'd hook up with every once in awhile, pulled it off and got to screw me raw for a couple of seconds before I'd pull away in horror. What gets me is he saw the fear in my eyes and he knew just how terrified I was of catching HIV, yet, he pulled the stunt twice. I will never understand how someone could be so callous to completely disregard another's life, future, and well-being, and put a one-time orgasm ahead of everything.

I understand it's a fantasy to some of you, but it's absolutely unacceptable to go around pozzing negative individuals. Why not grab a syringe and go around randomly sticking people with infected blood? As much as some of you might think that's totally different, it isn't. At the end of the day, you're willingly infecting someone. I like this forum and lurk occasionally, but the small number of posts I've read from members who intentionally infect unsuspecting negative bottoms are creepy, to say the least. I've known this guy on a few sites, though obviously we haven't chatted in some time. He always came across as a rather cocky, rather careless individual. Yeah, he loved to poz up neg holes. But as we can all see here, a little discretion would have done Mr. Boone a lot of good. He also should have chosen his bottoms a little better. To paraphrase from a sci-fi canon, Neg boys and virgins can be succulent...but sometimes they bite back!
