It can be argued that this young man was mature and more than willing to have sex with Mr. Wolf, and that 18 is an arbitrary number for age of consent.  Perhaps.  But, an objective number is the only way the law can work.  Trying to base things on whether the young person involved is mature enough to make these decisions would make the law too unpredictable for everyone involved, especially the adult.

 

The age of consent in NY is 17.  The age of consent in Connecticut, MA, PA, NJ and VT is 16.  So the crossing the state thing is to specifically try to convict Wolf/Smith of a federal crime,  enticement of a minor.

   This seems targeted and to some extent trumped-up.  If they can't get him on actual child pornography charges then this seems excessive.  Unless of course he did try to get the young man involved in prostitution.  Otherwise the sexual activity detailed so far, while a criminal offense, seems to have been excessively trumped up.  Also this law seems to possibly conflict with the age of consent from the state that the young man was/is resident in.  The intent of this enticement law seems to be to stop trafficking, exploitation and specifically prostitution, although "or any sexual activity for which a criminal offense can be charged" leaves quite a bit of wiggle room to permit prosecutors room for an excessive prosecution.  

Also, when was the last time a female having sex with an underage boy was actually prosecuted?  There have been some but they were invariably women (often teachers) exploiting elementary school kids.  I haven't even heard of a woman having sex with a middle school kid being prosecuted (although perhaps there have been) and certainly not with a high school kid, other than to loose their jobs, unless the hs kid was deemed not mentally competent.  

For example, the infamous case of the child actor JB at age 17 having had sex with a 37 year old actress in a hotel room in CA.  The age of consent for CA is 18.  The actress admitted that she did indeed have sex with JB but this was basically treated like a Hollywood tempest in a teacup.  The then 37 yr old actress was also a leader in the MeToo   group that accused Harvey Weinstein of his abuse.  There was indeed a major financial payment made to JB but nobody was talking about 10 years in prison for the actress.

I am going to have to disagree with your analysis. Unless he had shitty legal representation, they would not have allowed him to plead out to a charge unless in their estimation this was his best path. Although I do agree that if the child porn case was ironclad, they would have pursued it. Someone in his legal team made the judgement that the chance of the porn conviction was high enough that it was not worth risking.

And please remember that the distribution of CSAM (Child Sex Abuse Material) is via things like Telegram or Session is nearly as bad as actually committing rape against a kid. If there was no demand for CSAM people would make far less of it. 

I use BDSMLR a lot and some of what is presented to me on my feed sometimes creeps me the fuck out. I never reblog something that's even borderline. I'm not generally into young men (under 20)  so I don't get a lot of it, but it's out there.

It doesn't really matter what the age of consent is in NJ, if the sex occurred in NY.  And, for federal offenses, the age of consent in any particular state doesn't matter because the federal definition will take priority.

Okay.  This seems to be a federal offense in the Wolf/Smith case because Wolf had sex with a 15 yr old who also crossed state lines (unless Wolf tried to prostitute the 15 yr old).

With the position of the current WH and DOJ, they can wait in NYC and arbitrarily declare a lot of sex with young men in violation of the enticement law.  They could easily target people they want to put in prison or possibly use it to put sex businesses out of business or parties if they mess up, maybe even if they do everything right but the 16 yr olds they use to set people up have seemingly legitimate but fake id's.  And the NJ->NYC fake id thing has been a real issue since basically forever. 

We know for a fact that law enforcement targeted people in the past while forcing a person to comply with their trap attempts (when this happened last in a methodical way, people who were discovered to just be gay alone could then be forced to entrap others, in the military in the 80's and earlier with pawns who were used by local police forces - nowadays if a 16 yr old came up on a drug charge in say NJ, they could be enticed to lure a gay man in NYC into sex and then the police could claim that the person entrapped had originally enticed the 16 yr old because of the fact that they crossed state lines).  The 16 yr olds themselves don't have to know that they are being used to entrap people either. 

This specific law seems to be ready made to help enhance the transformation of the US into a toxic police state and use the power of the state to get rid of gay men.

The USA is a police state like Nazi Germany or the Soviet Union or like the USA of the mid-late 70's when people could be regularly targeted by federal and local police or like the USA of the 90's and early 2000's which had secret prisons in Chicago -this last one was run by the Chicago police.

Given that the current Presidential admin wants to revive the USA police state (which they DO want to do since they are literally disappearing people and running a gulag system by paying El Salvador to house prisoners that the USA dumped in their CECOT prison AND also claim they have no details about the prisoners and they denied due process to all of these prisoners) and given that there is a clause in the enticement law that might permit prosecutors to basically do what they want, then because of the special geographic circumstances of NYC, DOJ could set up entrapment of gay men by sending in 16 yr olds that they have legal leverage with.  It's a dream law for the fundamentalist religions branch of MAGA to begin to reenact their fascist (gays must die or be completely excluded from society and may not fuck ever, gays can't be employed since they are disgusting and want to spread their diseases so we have to impoverish them, gays are pedophiles and what the Iranians do to them is what we should do too, we need to set up gay men and remove their evil from society).  You know, a revival of exactly what the USA did to gay men before around 1977.

I don't fault you for feeling what you did or for stating it ( even though I wish you had been less biting in your words as being too blunt or harsh can be harmful to others. )


I was having a particularly hard time understanding the particular writer's @fuckholedc post as well and was actually wondering why that was the case, until I went and checked his profile today which gives me a bit of insight about it. 

His background states that he came Out while living in Europe as a young man and he has lived in Washington DC ever since. He is likely a non-native English speaker, and thus has a harder time expressing what he wishes in English. He tends to do so in the French, Dutch or Germany style and manner of expression. The result is a writing that seems slightly dense and sometimes difficult to understand. 

We are united here on this site for our love of barebacking sex and not the Queen's English, and thus should strive to be tolerant of all levels of English abilities 🙂. This incident just highlights what I have expressed in another post about allowing some so called foreign languages which are compatibility with English on this site.
