I for one definitely appreciate @BootmanLA legal clarifications.  TBH I don't give a rip about how this specific case plays out; it'll be what it turns out to be.  Having navigated legal cases as both a defendant and a plaintiff; in particular as a defendant it was interesting to have enough background that I could observe with insight the finesse of both the Judge and my attorney.  At a point I could observe the palpable change in the judge towards my side.  

I have sympathy for Austin Wolf.  It can feel like a daunting task to build a defense.  

I have been curious about something for awhile; but don't really have the technical reach anymore to get good answers.  But I am aware of a local case regarding a police officer and this sort of porn.  I am wondering if there are cases of the Phishing Payload being porn instead of malware? Would it be that easy to insert compromising information onto any device on the web?

Easy is in the eye of the beholder.

For starters, while phishing attacks are common, successful ones aren't nearly as abundant. Thanks to fairly decent spam filters and other anti-malware software, as well as people's tendency to delete email they don't recognize (not enough, but still...), it's harder to reach vulnerable people.

Second, there's no "payoff" for the payload-delivering site, usually; they want money, not just to annoy people. And targeting malware would be even harder, because you'd have to craft a message specific for your target that they would be convinced to check out.

Separately, there's almost always a way to tell where files like that came from, so if the malware people were forcing CP/CSAM onto someone's computer in an attempt to compromise him, forensics would probably be able to tell that it came from a malware site and wasn't actively sought out by the person.

Could it be done? Probably. But I don't think it's likely.

Yes that's been my POV as well, and mostly still is.  But I could see the payoff being political.  Get rid of the cooperative cop to gain access to a more corrupt one.  Some of this absurd national BS is permeating local governments as well.

A video, video-clip, movie, or similar visual depiction is treated as 75 images. (US Sentencing Guideline §2G2.2, Application Note 6) When more than 600 images are involved, the offense level is increased by 5. (US Sentencing Guideline §2G2.2(b)(7)) As part of a plea agreement, the government can agree to a lower number of images which in turn leads to a smaller increase in the offense level. It might sound like small beans, but 2 points off the offense level, say from 40 to 38, can mean a sentence range 5 to 7 years lower. Acceptance of responsibility, which drops 2 points off the offense level, can have a similar effect.]

I would think it depends on how visible the person they want to find guilty is. Wolfe is a huge producer of gay material and he has capitalized  on the experienced man and boyish newbie for a very long time and in whole groups of film, it wouldn’t surprise me if the laws weee being applied to end his kind of product. Isn’t that what was done to Max Hardcore a decade ago?

I like Nevada's approach of sexual assault of a minor (<14), life in prison with no chance of parole for 10 years. 

This should be applied across the board not only in all states, but all countries (adjusted for localised age of consent).

This should apply to those who are knowingly distributing images and videos of sex assault of a minor.

I'm very much of the opinion innocent until proven guilty, however to those saying that there should be leniency because of a first time offence (not just AW), FUCK OFF. If it can be proven that anyone was knownly distributing this abuse material, then there should be no leniency whatsoever.

This isn't stealing from a shop or mugging someone, this is sharing indecent images of children being raped and abused for profit, how depraved and vile does one have to be to call for leniency of something so horrific is beyond me.

I've been hooking up with men 18 to 64 since 10 years age. I'm 23 btw. It was always consensual and I verg well knew and understood what I was doing with a man as i always knew long before that even. If I'm able to understand about sex and want it when so young and actively look for older men when I was younger then it stands to say that the law is incorrect to begin with. Consent is consent no matter what although I only do men 18 to 39 myself as i ain't risking being locked away for dumb ass reasons like that but age of consent in law is also different in each country which is also proof that those who enforce said laws just talk alot of shit with no understanding on how a mind works.

If anything in this day and age it should be updated considering how sex and all is more commonly accessed on media and the Internet which shapes our minds and understanding and should have a universal law all over the world for the age of consent to be the same everywhere and people shouldn't be charged if said young people are actively chasing them while being fully aware of sex and all.

It's mainly why I never told anyone about any of the adults I hooked up with in my past lol as I think the punishment is fucked up and people shouldn't be labeled horrible words just because young guys like me wanted to be with an older man.

It's no different to guys on here who chase poz guys. Might as well say we should put gifters on the register as well and lock them up for 10+ years just because a chaser actively and willingly hooked up with a guy he knew was poz while he fully understate risks of doing so. Or lock up guys who didn't know they were poz and accidentally pozzed someone because either the guy who pozzed them didn't tell him his status or because he gets false test results from a doctor by accident. 

The laws and rules should be more lenient towards those who actively look to hookup with older and not hold said older people responsible for such things when both sides agree to consent and all.😂

If it was legal I would have hooked up with older men more often In the past and enjoy every second.

FYI I never regretted a single hookup with being with men and am not traumatised or anything in any shape or form whatsoever and I wasn't raised in an environment full of inappropriate stuff whatsoever so i jnkw for a fact that it is possible to have a mind of an adult and think and feel like them at a young age and think they should actually do a clinical study on adults on when they started thinking about sex and all when they were younger to better understand the mind on both gender sides and make the law based on results instead of pulling random numbers out a hat like some  half assed party trick.

I'm all for challenging laws regarding age of consent, but not necessarily in the way that you have expressed here. The laws around ages someone is legally allowed to do things are screwed up, but they'll unfortunately never change (unless it's to move for equality e.g. Hetrosexual and Homosexual consent ages) as the political party that announces any increase or decrease with any of the laws will face serious backlash from the other parties and depending which way they're suggesting, the public. 

In UK here is a simplified breakdown:

  • Universal age of consent: 16
  • Legal age of driving a moped/scooter: 16
  • Legal age of driving a car: 17
  • Alcohol and Voting age: 18

So at 16 someone can have a child and drive a moped/scooter, but can't vote in elections that could impact their child or taxes they pay for driving, and this is even more screwed up in some countries that have a lower age of consent but the two people can't be more than x years apart in age. 

In my opinion the age of consent, driving, drinking and voting should all be the same age whatever that age is. 

Two 16 or 17 year olds could be in a loving committed relationship, even have a child together, but if they were to send sexual images of themselves to each other, they're technically distributing explicit images of a minor as they're both under the age of 18. 

With all that said, based on the current law, AW may have committed a crime in the distribution of sexual explicit images of children and regardless of the fact that they may have consented due to their matured understanding, under the law as it stands the individuals are not legally allowed to consent to the activity that took place.

Nope. Paul Little (aka Max Hardcore) was convicted of obscenity charges for material his studio actually produced. It had nothing to do with transmission of child porn or anything like that.

What you may be thinking of is that he was convicted in Florida because the material was distributed there, even though it was produced elsewhere. But once you've produced obscene material (which isn't protected by the First Amendment), you can be prosecuted anywhere it's shipped (electronically, if it's online). Nobody planted material on Max Hardcore's computers or anything like that.

Also, I'd note: I'm sure Wolfe's own films almost certainly have the proper paperwork documenting that all the performers are of legal age. And again, I'd suggest that it's pretty hard to fake porn being sent from phone A to phone B when the feds have phone B in their possession at the time the material was sent, and once they retrieve phone A, find the corresponding sending record on that phone.

I looked for more information on this and the only reporting about LeGrand Wolf is a Tic Tok story. Austin Wolf, an adult film star was arrested for child pornography posession, but it could be the LeGrand Wolff story is out of proportion

 I'd like to add my perspective.

The system is broken. it's broken in several places, and I've many systems it is irreparable. That being said, SOME system is better than none

Our shared Human history is filled with Adults expecting and forcing children to make decisions or participate in things they are ready for, be that emotional or physical.

in much of the world, the concept of  "preteens / teenagers " wasn't a thing before the 1950's  And 50 years before that, what we would consider "Minors" , especially female minors were already mothers with children, long before they could understand any of the kind of  maturity  that is supposed to exist today.

 I find it screwed up that children can be indoctrinated into "national service" an war mongering, before they are taught about body auto omy, body positivity, real and true consent and yes even sex. 

In my country of the US a Teen trained to fight and die on a god forsaken battlefield before they can legally.... Smoke, drink alcohol, be sexually active with a partner they choose, Rent an apartment, rent a car.  Vote. and there are people that want to raise the voting age to keep young people from voting to change the establishment 

 Only recently was Sentencing a child to a life term with no parole or to execution outlawed, and with the hard conservative lean in our highest court, that decision can be overturned at any moment. 

That shit is insane.

 

When I was a child I was a victim. I was raped repeatedly by a group of scum sucking bastards. The line began with my own father and didn't end until I tasted Puberty. I was photographed, videos and passed around, sometimes for nothing more than a drink for my old man. I wasn't alone. many kids in my neighborhood went through this, and I don't know how I wasn't Poz before I was 10 It was a dark and scary time.

For years the only way I could stop myself from canceling my subscription to breathing, I had to recoceptualize my experiences to ones where I had the power I didn't have. I had to be outside of my body and accept the involuntary pleasure forced upon me.

Because yes, a kid is human. yes a kid can feel pleasure, yes a kid can learn rewards are better than punishments. 

when I was in my teens I became a predator. I put adult men in situations that got me the attention I sought, because it was the attention I had been conditioned to value. I sold myself, I blackmailed, I begged , I pleaded and put myself into dangerous situations to get thevsexual satisfaction I craved in my teens. itvwas easy.  Farveasier than it is no that I am Overweight, Scarred and Poz

Do I have dark fantasies you bet I do have I seen some things that disgust me with myself upon post nut clarity. yes.

 

But even if I am a dumpster fire, I want to see more protection. and a new system built, to protect the weakest and most easily exploited among us. 

 

I hope I've constructively added to the discussion  with my perspective.
